A growing litigation of Lipitor lawsuit claims alleging new-onset diabetes caused by the cholesterol-lowering medication gained two new plaintiffs this month in cases filed in Pennsylvania federal court, reports indicate.
According to a DailyItem.com article published on January 17th, both cases have been filed by individuals who claim to have experienced side effects from Lipitor, a statin designed to lower LDL (bad) cholesterol and other fatty substances in the blood streams of recipients. The most recent plaintiff, along with another woman claiming similar Lipitor diabetes injuries from the Pfizer, Inc. medication, filed suit the same week in the U.S. Middle District Court.
According to one case, which accuses Lipitor’s manufacturer of failing to warn about its side effects, a woman was prescribed the medication at the age of 60 to decrease her risk for cardiovascular disease. In May 2013, she developed Type 2 diabetes after taking the drug since 2004. The other Pennsylvania claim states that the Plaintiff was diagnosed with diabetes four years after she started Lipitor in 2008, and has since experienced blurred vision, occasional dizziness and numbness in the feet. She is also at an increased risk for heart disease, neuropathy and blindness, according to the suit, which also states that would have more closely monitored her blood sugar levels during the time she had been aware the Lipitor diabetes association. It was not until after both Plaintiffs began using the medication that Pfizer adjusted its labeling in 2012 to include the risk for this disease.
Claims included in these Lipitor lawsuits bear similarity to those pending in jurisdictions across the U.S. Court documents from January show that over 100 cases accusing Pfizer of negligence, negligent representation and fraud, among other claims.
Plaintiffs in these cases have requested that the U.S. Judicial Panel on Multidistrict Litigation (JPML) coordinate Lipitor lawsuits in a single proceeding, but a federal litigation has not yet been established. The Panel is scheduled to hear arguments on the matter on January 30th, 2014.
